Mr. X wrote in about a problem with his broadband bill from BSNL.

An incident of Bandwidth Stealing through a BSNL wireless modem has occurred. Here are a few more details into the entire case. The bill for the month of August (from 1st August - 31st August 2007) is Rs 54,401/- whereas it has never exceeded Rs. 700/- for a month. It has been identified by the complainant that the bandwidth was in fact stolen as he has found 4 other user profiles accessing his modem.

Following this, the complainant approached the Cyber Crime Police Station and the Police Department. Both of them have rejected to filing the FIR or the complaint, saying that this doesn't fall under their jurisdiction. The Cyber Crime department mentioned that this incident doesn't come under IT Act (2000) and recommended that the complainant approach the Bangalore Police. The Bangalore Police told him that this doesn't come under their jurisdiction and they wont even file a FIR.

  • Are there any clear guidelines for identifying a fraudulent act of stealing Internet bandwidth? If so, how is it detected?
  • Who is responsible for detecting whether there has been any such incident?
  • Is there a regulatory body in the Government dedicated to investigate and prosecute in such cases?
  • Which Act under the Indian Constitution deals with Bandwidth stealing?
  • What is the process to find out who is responsible for such illicit usage?
  • What is the process to file a complaint?
